Terms of Service for Photography Services

1. Introduction

These Terms of Service (“Terms”) govern all photography/Videography services (“Services”) provided by Duast Media (“Photographer,” “we,” “us,” or “our”). By booking or purchasing our Services, the client (“Client,” “you,” or “your”) agrees to these Terms.

2. Booking & Payment

  • A non‑refundable retainer may be required to secure your session date. This amount will be agreed to prior to work commencement.

  • Remaining balances are due within 10 business days or project completion.

  • Dates may not be reserved until the retainer is received.

  • Payments may be made via ACH or Debit/Credit card.

3. Cancellations & Rescheduling

  • Cancellations made by the Client result in forfeiture of the retainer.

  • Rescheduling is allowed 2 times with at least 24 hours’ notice, subject to availability.

  • If the Photographer must cancel due to illness, emergency, or circumstances beyond our control, the Client may choose a rescheduled date or receive a full refund of all payments made.

4. Session Expectations

  • The Client agrees to arrive on time and prepared for the session, if applicable.

  • Late arrivals may reduce shooting time or result in cancellation without refund.

  • The Photographer is not responsible for uncooperative subjects, weather conditions, or other factors outside our control.  We will make every effort to complete the work within the limits of the photo/video hardware in use.

5. Editing & Delivery

  • Standard editing includes color correction, exposure adjustments, and basic retouching.

  • Advanced retouching (e.g., body modification, object removal) may incur additional fees.

  • Final images will be delivered 48 hours via Google Drive share.  Alternatively, client may provide a delivery share point they will be responsible for

  • Any Google Drive share provided will be removed after 14 calendar days of initial share.  We encourage the client to download all content prior to the 14-day expiration of share.

  • RAW/unedited files are not provided under any circumstances, except as agreed.

6. Copyright & Usage Rights

  • The Photographer retains full copyright to all images created, unless otherwise agreed in writing by both parties.

  • The Client receives a non‑exclusive, non‑transferable license for personal and/or commercial use, including printing and sharing on social media with proper credit.

  • Commercial resale, or alteration of images is prohibited unless explicitly agreed upon in writing.

  • The Photographer may use images for portfolio, marketing, and promotional purposes unless the Client requests otherwise in writing before the session.

7. Model Release

By booking a session, the Client grants permission for the Photographer to use images featuring the Client or their likeness for promotional purposes, unless a written opt‑out is provided.

8. Liability

  • The Photographer is not liable for injury, property damage, or loss during the session.

  • In the unlikely event of equipment failure, data loss, or other unforeseen issues, the Photographer’s liability is limited to a refund of all payments made.

9. Weather & Location

  • Outdoor sessions may be rescheduled due to unsafe or unsuitable weather conditions at the Photographer’s discretion.

  • The Client is responsible for obtaining any required permits or permissions for chosen locations.

  • In event of aerial photo/video work, Duast Media will be responsible to request and obtain any required approvals or permits from FAA or local air regulatory agencies

10. Additional Fees

Additional charges may apply for:

  • Travel beyond the agreed to location, or as agreed

  • Location permits

  • Rush delivery

  • Extended session time

  • Additional edits or retouching

11. Agreement

By booking a session with Duast Media, the Client acknowledges that they have read, understood, and agreed to these Terms of Service.
